Description of Service
Livecarts provides AI-powered abandoned cart recovery services through:
- Personalized phone call outreach to customers with abandoned carts
- SMS messaging with direct links to abandoned carts
- Special discount offers and purchase support
- Voice cloning technology for realistic customer interactions
Our service is performance-based - we only charge when we successfully recover abandoned carts.
Eligibility
To use Livecarts, you must:
- Be at least 18 years of age
- Operate a legitimate e-commerce business
- Have the legal authority to enter into this agreement
- Comply with all applicable laws and regulations
Customer Consent Requirements
You agree to:
- Obtain proper consent from customers before we contact them
- Comply with TCPA, GDPR, CCPA, and all applicable messaging laws
- Only provide contact information for customers who have opted in
- Maintain records of customer consent
- Honor customer opt-out requests immediately
Pricing and Payment
Livecarts operates on a performance-based pricing model:
- You are only charged for successfully recovered abandoned carts
- Pricing is agreed upon during onboarding
- Payments are processed according to the payment schedule in your agreement
- All fees are non-refundable once services are rendered
Your Responsibilities
As a Livecarts customer, you are responsible for:
- Providing accurate customer data and cart information
- Integrating Livecarts properly with your e-commerce platform
- Ensuring your products and services comply with all laws
- Honoring all discounts and offers made through our service
- Maintaining the security of your account credentials
Prohibited Uses
You may not use Livecarts to:
- Contact customers without proper consent
- Sell illegal, counterfeit, or prohibited products
- Engage in deceptive or fraudulent practices
- Violate any applicable laws or regulations
- Harass or spam customers
- Interfere with or disrupt our services
Intellectual Property
Livecarts retains all rights to:
- Our AI technology and algorithms
- Software, code, and platform
- Branding, logos, and trademarks
- Documentation and materials
You retain ownership of your customer data, product information, and brand assets.
Data Usage and Privacy
Our use of data is governed by our Privacy Policy. By using Livecarts, you acknowledge:
- We will process customer data to provide our services
- We maintain SOC 2, HIPAA, and GDPR compliance
- We do not sell customer data to third parties
- Data security is a top priority
Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We reserve the right to:
- Perform scheduled maintenance
- Make updates and improvements
- Suspend service for technical issues
- Modify features and functionality
Limitation of Liability
To the maximum extent permitted by law:
- Livecarts is not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed fees paid in the last 12 months
- We are not responsible for third-party integrations or platforms
- Services are provided "as is" without warranties
Indemnification
You agree to indemnify and hold Livecarts harmless from any claims arising from:
- Your violation of these Terms of Service
- Your violation of applicable laws
- Lack of proper customer consent
- Your products, services, or business practices
Termination
Either party may terminate this agreement with 30 days written notice. We may terminate immediately if:
- You violate these terms
- You engage in fraudulent activity
- Payment obligations are not met
- Required by law
SMS Program Terms
By opting in to receive SMS messages from LiveCarts, you agree to the following terms:
- Program Description: LiveCarts offers an SMS program to send you promotional offers and discounts related to your abandoned shopping carts.
- Message Frequency: Message frequency varies. You may receive promotional messages based on your activity and our campaigns.
- Message & Data Rates: Message and data rates may apply. Please check with your mobile carrier for details on your messaging plan.
- Opt-Out: You can opt out of receiving SMS messages at any time by replying STOP to any message. You will receive a confirmation message that you have been unsubscribed.
- Help: For assistance, reply HELP to any message or contact us at livecarts.io/support.
- Privacy: Your mobile phone number will not be sold or shared with third parties for their marketing purposes. See our Privacy Policy for more information.
- Carrier Support: This service is available on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
By providing your phone number and opting in, you consent to receive automated promotional SMS messages from LiveCarts. Consent is not a condition of purchase.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes via email or through our platform. Continued use of our services constitutes acceptance of the updated terms.
Governing Law
